Terms of Service
These Terms of Service govern access to the LEVELYM websites, application and related services. By creating an account or using LEVELYM, you agree to these Terms.

1. Provider and agreement
LEVELYM is currently operated by Anton Pozdeev, intended to operate as an Individual Entrepreneur in Georgia (registration pending; registration number and registered business address pending), referred to as “LEVELYM”, “we”, “us” or “our”.
These Terms form an agreement between LEVELYM and the person or organisation using the service. If you use LEVELYM for a business or on behalf of another person or organisation, you confirm that you have authority to bind them.
The Privacy Policy explains how personal data is handled and forms part of your use of the service. Questions can be sent to support@levelym.com.
2. What LEVELYM provides
LEVELYM is a web-based workspace for independent tutors who teach primarily 1-to-1 and for their invited students. Features may include scheduling and self-booking, student profiles, lessons, notes, recaps, homework, progress, messages, notifications and optional AI or speech tools.
LEVELYM organises work around teaching. It is not a school, educational institution, employer, tutor marketplace, payment service for lessons, video-conferencing service or provider of professional educational, medical, legal or safeguarding advice.
3. Eligibility and accounts
You must have the legal capacity to enter into these Terms. If you do not, a parent, legal guardian or other authorised adult must approve your use and accept responsibility where required by law.
You must provide accurate information, use only your own authorised sign-in method and keep your Google account, devices and invitation links secure. You are responsible for activity under your account unless caused by our breach. Tell us promptly about suspected unauthorised access.
You may not transfer an account or impersonate another person. We may refuse registration where reasonably necessary for security, legal compliance or service integrity.
4. Tutors, students and guardians
Tutors control their teaching practice and remain responsible for lesson decisions, schedules, communications, student relationships, safeguarding, tax and professional obligations, and the accuracy and lawfulness of information they add.
Before adding or inviting a student, a tutor must have a lawful basis to use that student’s data and provide any required notice. Where a student is a minor or lacks legal capacity, the tutor must obtain parent or legal-guardian authorisation where required and use age-appropriate content and communications.
Students must use the service only for their own learning relationship and respect the tutor’s and other users’ rights. LEVELYM is not a party to the separate teaching arrangement between tutor and student and is not responsible for lesson delivery, quality, cancellations, fees paid directly to a tutor or disputes between them.
5. Your content
You retain ownership of content you submit to LEVELYM, including notes, lesson records, messages, audio, homework and other materials (“User Content”). You give us a limited, worldwide, non-exclusive licence to host, copy, transmit, display, format and process User Content only as needed to operate, secure, support and improve the service and to meet legal obligations.
You confirm that you have the necessary rights and permissions for User Content and that it does not unlawfully disclose confidential information, infringe intellectual-property or privacy rights, or violate applicable law.
The service separates tutor-private and student-visible areas. You are responsible for choosing the correct area before saving or sharing content.
6. AI and speech features
AI and speech features are optional. They may use selected student context, recordings, lesson information or instructions to produce transcripts, recaps or homework drafts.
Generated output can be incomplete, inaccurate or unsuitable. Tutors must exercise professional judgment and review, edit and approve all output before sharing it or relying on it. Do not use generated output as the sole basis for a high-impact decision about a student.
You must not submit content you are not authorised to process or unnecessary sensitive data. LEVELYM does not claim ownership of your input or output, but rights in generated output may vary under applicable law.
7. Acceptable use
You must not use LEVELYM to:
- Break the law, infringe another person’s rights, breach confidentiality or facilitate harm, abuse, exploitation, discrimination or harassment.
- Upload malware, disrupt or overload the service, bypass security or access controls, probe for vulnerabilities without written permission, or access another user’s account or data.
- Scrape, resell, sublicense or commercially exploit the service except as expressly allowed, or reverse engineer it except where the law does not permit that restriction.
- Send spam, misleading invitations or unauthorised marketing, or use the service to create deceptive, unlawful or unsafe content.
- Present AI-generated material as verified without appropriate review, or use LEVELYM for fully automated decisions with legal or similarly significant effects.
8. Service availability and changes
We aim to provide a reliable service, but LEVELYM may be unavailable during maintenance, updates or events beyond reasonable control. Features may be added, changed or discontinued as the product develops.
We will use reasonable efforts to give advance notice of a material change that significantly reduces core paid functionality. Preview, beta or free features may change without notice and may be subject to additional conditions.
You should keep copies of User Content that is important to your teaching practice. LEVELYM is not a guaranteed archival or emergency communication service.
9. Plans, credits and payment
The current marketing site describes a free practice with up to five active students. When a tutor has six or more active students, the intended model charges for the full active student count at an estimated rate of approximately USD 1 per active student per month, calculated daily through LEVELYM credits. Students use LEVELYM without charge.
Paid checkout is not enabled as of the date of this draft. No fee will be charged unless the price, taxes if applicable, definition of an active student, billing frequency, payment method and any renewal terms are clearly shown and you expressly confirm a payment obligation.
Prices and plan rules may change prospectively. We will give reasonable advance notice of material changes affecting an existing paid plan. Taxes, currency conversion and payment-provider fees may apply as disclosed at checkout.
10. Cancellation, withdrawal and refunds
You may stop using LEVELYM at any time. When paid features become available, the account and checkout flow will state how to cancel and when cancellation takes effect. Cancellation does not automatically create a refund for service already provided, except where required by law or expressly stated at purchase.
If mandatory consumer law gives you a cooling-off, withdrawal, cancellation or refund right, that right is not limited by these Terms. Where applicable to a distance service contract, you may have 14 calendar days to withdraw; if you expressly ask for service to begin during that period, the amount payable may be proportionate to service already supplied, as permitted by law.
To request cancellation, withdrawal or a refund, contact support@levelym.com and include the account email and relevant transaction details.
11. LEVELYM intellectual property
LEVELYM and its software, design, branding, documentation and service content—excluding User Content—are owned by us or our licensors and are protected by intellectual-property laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the service for your own teaching, learning or internal business purposes. No other rights are granted.
If you voluntarily provide feedback, you allow us to use it without restriction or payment, provided that we do not publicly identify you without permission.
12. Third-party services
LEVELYM may depend on or link to third-party services such as Google authentication, hosting, analytics, messaging, AI, speech and future payment providers. Their own terms and privacy notices may apply.
We are not responsible for a third-party service outside our control, but this does not limit obligations we have when a provider processes personal data for us.
13. Suspension and termination
You may request account deletion through the available account controls or support. We may suspend or terminate access if you materially breach these Terms, create a security or legal risk, fail to pay an undisputed amount when due, or use the service in a way that could harm users or LEVELYM.
Where reasonable, we will give notice and an opportunity to remedy the issue. We may act immediately when needed to protect users, data or the service, or to comply with law.
After termination, your right to use the service ends. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, liability limits and dispute terms—will continue. Deletion and retention are handled as described in the Privacy Policy.
14. Disclaimers
To the fullest extent permitted by law, LEVELYM is provided “as is” and “as available”. We do not promise that the service will always be uninterrupted, error-free or meet every professional requirement, or that AI-generated or user-provided content will be accurate.
Nothing in these Terms excludes warranties, remedies or other rights that cannot lawfully be excluded, including mandatory consumer rights.
15. Limitation of liability
To the fullest extent permitted by law, LEVELYM will not be liable for indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, goodwill or data, arising from use of the service.
To the fullest extent permitted by law, LEVELYM’s total liability arising from the service during any 12-month period will not exceed the greater of the amount you paid to LEVELYM during that period or USD 100.
These limits do not apply to liability that cannot lawfully be limited or excluded, including liability for fraud, wilful misconduct, gross negligence where applicable, or death or personal injury caused by negligence.
16. Changes to these Terms
We may update these Terms to reflect changes to LEVELYM, our business or the law. We will post the updated Terms and change the “Last updated” date. For a material change, we will give reasonable advance notice through the service, by email or by another appropriate method.
Changes apply prospectively from the stated effective date. If you do not agree, you should stop using the service and cancel any paid plan before the change takes effect.
17. Governing law and disputes
These Terms are governed by the laws of Georgia, without regard to conflict-of-law rules. Courts with jurisdiction in Tbilisi, Georgia will have jurisdiction over disputes, unless mandatory law gives you the right to bring a claim elsewhere.
Before filing a claim, you and LEVELYM agree to make a reasonable good-faith effort to resolve the matter through support. Nothing in this section prevents either party from seeking urgent protective relief or using a mandatory regulatory or consumer-redress procedure.
18. General terms and contact
If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation, financing, merger or transfer of the service, subject to applicable law.
These Terms, the Privacy Policy and any plan-specific terms shown at purchase are the entire agreement about LEVELYM and replace earlier discussions about the same subject.
